Months after losing a malpractice lawsuit filed by one of its longtime plaintiffs, the San Diego City Attorney’s Office sued the outside law firm and one of its attorneys for alleged malpractice and other wrongdoing.

The lawsuit, filed last week in San Diego Superior Court, alleges the company and a former partner sparked a lawsuit that resulted in a $3.9 million jury verdict against the city this year.
“Reis breached the counsel’s duty to faithfully perform duties to the best of his knowledge and ability,” the lawsuit states. “The city has suffered substantial economic loss as a direct, foreseeable and proximate result of the defendants’ actions.”
According to the lawsuit, Price was defending the city in Dell’Anno’s case last year when he arranged a secret meeting with former Deputy City Manager Mark Skeels.
During the meeting, the suit says, Price suggested that Skeels could help if he painted Dell’Anno as unstable and ineffective. He also suggested that he should not discuss his relationship with Dell’Anno.

Soon after, Skels described what he said was wrong for Price to move his evidence in the post office. He accused Price of revealing more confidential information about the case to the woman Price was seeking.
The city removed Burke’s firm from the case and later fired Skeels, who later became a witness at Del Anno’s trial. He left Price County and now owns his home on the Scripps Ranch according to state records.
“The evidence and testimony regarding Cena’s conduct and incriminating threats was presented in court over the city’s objection, which was extremely damaging to the safety of the city and painted the city and its attorneys in a bad light,” the suit says.
Dell’Anno was fired in 2015 by former City Attorney Ian Goldsmith. The city said it was investigating cases of mishandling of files.

During his trial and later in court testimony, Dell’Anno said he was acquitted because, among other charges, he refused to be politically motivated in the prosecution of Goldsmith’s chief critic and San Diego prosecutor Cory Briggs.
City officials have appealed the verdict in the Del Ano case, and the judge’s $3.9 million award is still being challenged. San Diego attorney Josh Grunberg, who represented the city’s former attorney general, said the city’s case against Price and Burke is disappointing.
“It seems like the state attorney’s office is blaming someone for losing Dell’Anno’s case,” he said. “I’ll admit that the former city attorney fired the law against the capital prosecutor, now he wants to push his attorneys back to the case by criticizing him.”
Gruenberg is seeking $4 million in legal fees for his work representing Dell’Anno. There is no word on what it takes.

The state is seeking specific damages against Price and Burgo, including punitive damages for “money necessary to punish the defendants and temporarily deter such conduct.”
