So it’s no wonder that anyone involved in a car accident is afraid to contact a Kelowna lawyer. The purpose of this article is to try to alleviate some of the fears of dealing with lawyers.
Perhaps the first fear of contacting a Kelowna lawyer is the cost. However, most personal injury attorneys do not require an initial agreement. Also, if the decision to hire a lawyer, most will agree to take the case on a timely basis, which means that the lawyer will be paid a percentage of what the lawyer charges for the client. The Advocates Act regulates the maximum amount a lawyer can pay in potential legal fees.
Another fear is finding the right lawyer. Don’t be afraid to find the right lawyer. Friends, colleagues and family are good places to start. You can also check the yellow pages and the internet. If possible, it is a good idea to meet with more than one attorney. If you have been seriously injured, you will have a long-term relationship with your lawyer, so it is very important that you feel comfortable with your lawyer. The attorney must review your personal records (ie your doctor’s records and employment records) and know everything about you before you file your case. If the lawyer is part of the company, you should also check who will handle your cases. Even if you have more than one attorney on your case, there is nothing more frustrating to a client than to think they have hired their own attorney only to find out that someone else who is unfamiliar with their case , actually handles it. If someone else is in charge, ask to meet with that person.
If you have been in an accident, your first priority should be to see a doctor. Then you should make an appointment with a lawyer as soon as possible and preferably before you talk to anyone other than your doctor about the accident. Most personal injury attorneys will come to the client if you are in the hospital or have limited mobility. Important evidence can be lost (eg ski rope, evidence of traffic accidents, emergency clothing, debris, witnesses, etc.) if someone waits too long to see a lawyer. However, there is a deadline for starting the case. In general, a person has two years from the date of the accident to start a lawsuit, however there are some cases where the period is shorter. If the limitation period is not observed, the claim is lost.
Some are afraid of what to say and what not to say to a lawyer. In order for the lawyer to do his job properly, the lawyer needs complete, accurate and correct information. The relationship between the lawyer and the client is privileged, which means that the information given to the lawyer is confidential. There is no information to take. If you are not completely honest with the lawyer, including withholding information, it will give both the lawyer and you the wrong idea about your claim. Problems that are solved quickly are easier to deal with when they arise in the middle of demand. In addition, information that seems harmful can sometimes be useful. If a lawyer is hired, he or she will be your censor and decide what information must be disclosed to the other party.
