One or both spouses must have been residents of Virginia for at least six months before the date you file for divorce.
You and your spouse must agree on “no-fault” grounds for divorce. In a no-fault divorce, no one is to blame for the breakup of the marriage. You must accept that the marriage is no longer valid and you will not be able to reconcile. Virginia divorce laws also allow for a no-fault divorce, but that usually requires a contested divorce.
A no-fault divorce in Virginia requires that the spouses live separately without cohabitation for a minimum period of time:
“No cohabitation” means that during the legal separation you did not return to live together with the intention of trying to reconcile.
