How Many States Have A Concealed Carry Law – Florida became the 26th state to allow adults to carry concealed handguns without a license or permit.

On April 3, Florida Governor Ron DeSantis signed into law a gun ban law that allows adults in the Sunshine State to carry concealed weapons without state training or a license.

With DeSantis’ signature, carry is now legal in more than half the country. With a population of 23 million, Florida is the third largest state in the nation and the second largest state to ban unlicensed carry. Texas, the second most populous state, has eliminated licensing requirements in 2021.

Like most carry laws, Florida will allow people to carry concealed weapons in most public places. Some people will still be prohibited from carrying firearms, including those who are prohibited from owning firearms by state or federal law, including prior felony or domestic violence convictions.

Although most states now allow concealed carry without a permit, the majority of the US population still lives in states that do not require a license or permit to carry a concealed weapon. Including Florida, 142.7 million people live in license-free states, while 190.5 million people live in states that retain licensing requirements.

Almost every state required a permit to carry a concealed weapon for most of the 20th century. Until the 1990s, some states banned concealed carry altogether, although there has been a shift toward more permissive licensing systems over the decades. Things began to change again in 2003, when Alaska became the first state to pass a no-carry law and the second state to allow concealed carry without a permit, after Vermont, which never required it. In recent years, the pace of state adoption of laws on prohibited carry has increased significantly. As of 2021, 11 states have done so.

License-free carry, or constitutional carry as advocates call it, has been a top priority for gun groups, including the National Rifle Association and Gun Owners of America. They argue that the Constitution gives Americans the right to carry guns in the open without a government-issued permit, and that allowing more people to carry concealed weapons serves as a deterrent to crime.

Research on concealed carry is less favorable. A meta-analysis of studies on concealed carry laws by the RAND Corporation found supporting evidence (the strongest list of think tanks to date) that permits concealed carry laws, including “mandatory surrender” regimes that give authorities limited powers to refuse in issuing permits, may increase this number. the dead More limited evidence suggests that they may increase overall violent crime. According to RAND’s analysis, the evidence for warrantless carriage laws is particularly inconclusive, largely because of the limited amount of research on the rules.

Last year, the Supreme Court nearly ruled in favor of pro-gun groups in its ruling on permit applications.

For the first time, the right to carry weapons for self-defense in public places was recognized. While the Supreme Court did not rule that the licensing requirements were entirely unconstitutional, it did rule that states such as New York, which operated under a “may-issue” regime, allowing state officials to deny permits, could not use subjective criteria to determine compliance

By eliminating the permit requirement for carrying a concealed handgun, the state of Florida also eliminated the requirement that permit holders complete live-fire training before obtaining a permit. While permits will still be available for those wishing to travel to other states under repatriation agreements, fewer people are likely to apply for permits or study.

Gun reform groups strongly oppose unlicensed carry laws, saying that eliminating licensing requirements increases the risks of gun violence by allowing people to carry guns without training or background checks. Because Florida does not require a universal background check for all firearm purchases, as do most states with no-carry laws, a person can legally purchase a firearm from a certain dealer without a background check and legally carry the gun.

“Florida residents across the state are less safe because of this law,” said Samantha Barrios, D-Florida, director of the gun reform group Giffords. “Law enforcement will no longer be able to identify a criminal in someone who has passed a background check and public firearms training. The war will be a war.”

When it comes to unlicensed open carry, it’s still 25-25 states, as Florida is one of the few places in the country where open carry is illegal. As the state moves toward less stringent gun laws, it creates a very unusual set of laws. The changes take effect from July 1.

Only California, New York, New Jersey, Illinois and Washington prohibit open carry of firearms (while concealed carry requires a permit), the same category as Florida before the change. The other 25 states other than Florida that allow concealed carry without a permit also do not require an open carry permit. This is stated in a message from the Giffords Law Center.

For many decades, Vermont was the only state that did not require a permit to carry, so the practice is sometimes called Vermont carry. Unauthorized transportation is also called authorized. In 2011, Wyoming became the first state to pass or reintroduce similar laws.
