Over the years, Ronald S. surgeon. Bergman, of Des Moines, has clashed with the U.S. Department of Justice over money-laundering charges, defended former employees’ sexual harassment lawsuits and has been the focus of 22 board reviews. The case involves misconduct by a Polk County sheriff and the former director of the medical board.
Bergman, 74, is now suing the board in Polk County District Court, saying he was treated unfairly and should never have had to undergo a neuropsychological evaluation. As with most Iowa licensing board cases, the medical board has made very little public announcement about its case against Bergman. However, in recent court filings, the board released some of the information that led to the 2022 neuropsychological tests.
Noting that under Iowa law, the board is “prohibited from disclosing any investigative information that was not included in the final report” it decided to release in Bergman’s case, the board added that it is not prohibited from “discussing its own testimony about Bergman.” . brought up at a disciplinary hearing or mentioned in his court documents.
The evidence, the board said, includes sworn testimony from three doctors who examined Bergman before January 2022.

According to the board, Dr. David Demarest, a neurologist, examined Bergman and found that “his movements are definitely affected by visible tremors or tremors.”
Dr. Jeffrey DeFrancisco, an internal medicine specialist, said Bergman had a “significant concussion, but nothing critical to work on,” and Dr. Calvin Hansen, a neurologist who examined Bergman several times, said Bergman had a “tremor” that was most noticeable “when he extended his arms.”

Bergman also claims that the chairman of the board’s medical review committee testified that the board did not have the medical expertise to “verify” whether a concussion was present that would affect Bergman’s ability to safely perform surgery.
The board says it has the right to revoke Bergman’s license because he refused to abide by the terms of the disciplinary process. Bergman says the board overstepped its bounds by making the test one to fix.
“The board indicates that it has room to add something to the settlement agreement with the licensed physician,” Bergman’s lawyers told the court. “But the administration does not provide legal authority for that reason.” Why? Bergman’s dispute with the board began in January 2022, when the two sides reached a settlement after the board said he had a neurological condition that could affect his ability to perform surgery and engage in misconduct. when he sent an inappropriate message to an employee.
Bergman denied the charges but agreed to the board’s offer to resolve the case by abiding by restrictions on his business, paying a $250 civil penalty and completing a professional restriction course. The settlement also stipulated that Bergman’s license would be suspended until January 1, 2023, after which Bergman would be permanently barred from surgery.
However, in May 2022, the court granted Bergman’s request to allow him to serve for an additional six months, until July 1, 2023. As part of that arrangement, Bergman agreed to complete a full neuropsychological evaluation no later than November 2022.
Months later, Bergman reportedly learned that the sentence he received meant he could not be admitted to a local hospital and the operating room where he performed many of his surgeries. At the time, he complained that the need for a neuropsychological examination was “baked into” the final contract he signed in May 2022.

In October 2022, Bergman told the board that he did not intend to file an investigation. In December 2022, the board charged Bergman with failing to comply with the board’s recommendations, and in July 2023, the board voted to indefinitely suspend his medical license and bar him from practicing any form of medicine in Iowa.
Bergman’s attorney, Mark Humphrey, then filed a motion in court seeking review of the board’s decision, arguing that the neuropsychological evaluation requirement was imposed for an improper purpose and saying that in 2005, Kent Nebel, then the board’s CEO, was drunk. . in medicine, told a group of sailors that he was going “f- Dr. Bergman”.
Humphrey later filed another brief in the case, saying this time “this court has evidence that Kent Nebel had an ongoing alcohol problem that resulted in two OWI convictions.” Both charges are said to have occurred while Nebel was on the board, “raising the question of whether his alcohol problem affected his judgment regarding board disciplinary matters.”
Bergman’s first petition to the court points to a report documenting a total of 22 medical board investigations into Bergman that began in 1984 and continued through 2019. According to the petition, 14 of those investigations were closed without any action by the board.

Three of the cases resulted in confidential letters from the board, the petition states. One of the three cases involved claims that Bergman inappropriately photographed a female patient’s private parts, another involved misleading advertising, and the third involved “taking Bergman into the hospital,” although the claim is unspecified.
Bergman says the board’s investigation recently came as a result of a lawsuit filed by Peggy West, the former office manager of the Bergman-Folkers plastic surgery practice.
The suit, filed in October 2019, alleges that Bergman repeatedly and repeatedly “overbooked” patient services, flagged low patient services as including excessive and expensive services, and then billed the excess charges to Medicare, Medicaid and other reimbursement insurance companies.

He said he did not remember how he came to apply, or how he was offered the job of managing a clinic, saying his management experience was running horses on a farm.
West claimed that at an office party, Bergman showed him pictures of his penis and said she was sending the pictures to Bartholomew. Throughout his career, West says, Bergman was often blunt and outspoken with and against the women in the office, calling them “stupid desks” and “idiots.”
In February 2020, Dr. Susan Kuhnen sued Bergman and the clinic, saying he made inappropriate sexual comments to her and other female colleagues at the clinic as part of socialization. She said Bergman called her a “w—” and a “cow” and interrupted her request for medical help. The case was settled in court in March 2022.
West’s case was settled with Bergman agreeing to pay $685,427, $340,731 of which was considered restitution. The agreement stated that there was neither an admission of guilt on Bergman’s part nor an admission by the government that all her statements were not properly based.
