Answer: The state operates a crash system to deal with motor vehicle accidents. This means that the person who caused the accident is responsible for all resulting damages. If another driver was responsible for causing your recent accident, your first option for damages is to file a claim against their auto insurance policy. If you cannot fully recover through insurance alone, you may have the right to file a personal injury claim for your unpaid damages.

A: If you believe you were partially responsible for your recent accident, the state’s pure and comparative negligence rule will apply to your next personal injury case. For example, if you are 25% at fault and the other driver is 75% at fault, they are responsible for 75% of the damages claimed in the case, and you are responsible for the remaining 25%. If the plaintiff is awarded a percentage of fault, it will be deducted from his final judgment as a penalty.
