Marin said the seller agreed to drop the price to $15,000, so she and her husband agreed to meet with the seller, Jess Clayton Doherty.

“It was 2008 and we just looked around; he said we could ride him,” Marin said.

Marin and her husband say they gave the money to Doherty, and he gave them a receipt. He didn’t name the truck, even though Marin asked.

“He wanted to pay taxes, rights and licenses. He wanted to change it to my name and I would get the title in the mail,” Marin said.

Then Marin found out there was a loan on the truck that Doherty never paid, so the bank repossessed the truck. Doherty is currently behind bars in Brazoria County for an unrelated crime, while Marin is out on $15,000 bail.

Consumer experts say this type of scam is common, and it’s the main reason to get a title before paying for a used car.

“This is your legal argument; otherwise it’s just a wave and a lot of air and bye and you’re out,” said Dan Parsons of the BBB in Houston.

The Mariners are currently contacting the Brazoria County District Attorney’s Office to determine if Doherty can be charged.
