In Texas, keeping a criminal record is called an anonymity order. This order effectively hides criminal records from public view and prohibits law enforcement agencies from disclosing the records. Some government agencies may still have access to the data.
When a criminal record is expunged, the record is destroyed forever. Only people who have never been charged with a crime have had their sentences overturned, received a pardon or been released after a trial. Similarly, the anonymity order is only available if the plaintiff is adjourned and then dismissed.

In June 2015, the 84th Texas Legislature passed Senate Bill 1902, which expanded the nondisclosure requirement for first-time offenders with misdemeanor convictions. The law has been called a “second chance” bill because it allows people with a single felony conviction who cannot have their records sealed to seek nondisclosure orders.
Unfortunately, the legislative changes that came into force on 1 September 2015 only apply to crimes committed on or after that date. That means most Texans with a felony conviction before the effective date will remain ineligible for restraining orders.
