If you have a child under the age of 18, you may be wondering what a custody agreement with your ex-husband looks like after a divorce. In Iowa, legal custody defines the legal rights and responsibilities of both parents. Legal custody refers to a mother’s legal custody rights, which include “making decisions that affect our child’s legal status, medical care, education, extracurricular activities, and religious education.” Iowa Code § 598.1(5) (2010). Courts use different standards to determine the type of legal custody that parents should be awarded than those used to determine physical custody. Shared legal guardianship is the most common type of guardianship. If parents have joint legal custody, both have equal legal custody. ID CARD. Iowa has a strong policy for joint legal custody. Generally, conflict between parents is not sufficient to establish that a joint custody arrangement is improper.
